Terms of Sale

  1. A deposit equaling fifty percent of the total purchase price is required to initiate an order. The remaining balance will be collected upon receipt of the merchandise in our warehouse. When merchandise is shipped directly to the customer, payment in full must accompany the order. On partial deliveries a deposit on the purchase price of the undelivered items will be held, until backordered items are delivered.
  2. Since factory prices are subject to change without notice, Esprit Decor, Inc. reserves the right to increase a quoted price by an amount not to exceed the manufacturer’s increase. Should such an occasion arise, the customer will be notified.
  3. There will be a $35.00 service charge on all returned checks.
  4. In the event of non-payment or default of contract, purchaser agrees to pay twenty-one percent (21%) per annum interest on the unpaid balance as well as a ten percent (10%) late fee per month on unpaid balance. Purchaser also agrees to pay reasonable collection/attorney fees of twenty-five percent (25%) of the unpaid balance that may result from the recovery of non-payment or default.
  5. Cancellations will not be accepted after three (3) days from the date of the order. An order, once placed and accepted, can be canceled only with Esprit Decor, Inc., and upon terms which will indemnify Esprit Decor, Inc. against losses.
  6. Esprit Decor, Inc. makes no warranty as to the merchantability or as to the fitness of the merchandise for any particular use, and Esprit Decor, Inc. shall not be liable for any loss or damage, directly or indirectly, arising from the use of such merchandise or for consequential damages. The customer shall have the benefit of all warranties and guarantees issued by manufacturers. Merchandise is not guaranteed against fading, stretching, soiling, pilling, or pile crushing.
  7. It is the customer’s responsibility to check their copy of the order for accuracy. Unless we hear otherwise, your order will be delivered as written.
  8. Deliveries shall be subject to, and contingent upon strikes, labor difficulties, riot, war, fire delay, or defaults of common carriers, failure or curtailment in the Seller’s usual sources of supply, governmental decrees or orders, or, without limiting the foregoing, any other delays beyond the Seller’s reasonable control, and the Seller shall not be liable for any loss or damage arising therefrom. The Seller shall have the additional right, in the event of the happening of any of the above contingencies, at its option, to cancel the Contract or any part thereof, without any resulting liability. Any delivery not in dispute shall be paid for regardless of other controversies relating to other delivered or undelivered merchandise. Delivery dates and times of goods purchased and sold under this contract are subject to change without notice, and Esprit Decor, Inc. does not guarantee a date of delivery of the goods sold hereunder, and delay in delivery shall not void this Contract. Esprit Decor, Inc. is not responsible for delays in delivery due to the fault of the delivering carrier.
  9. Upon completion, your order will be placed on our routing desk for scheduling on the next available truck to your area. The time required for delivery will vary depending on the frequency with which we serve your area. Once scheduled you will be notified in advance with the date and approximate time of delivery. Our drivers will set up your furniture in your home. Our rates do not allow for precise fitting and leveling of modular furniture or wall units, nor the installation of wall mirrors. We also ask that the room in which the furniture is to be placed be cleared in advance of our arrival. Delivery fees are non-refundable after the merchandise has been delivered or an attempt to deliver has been made.
  10. In the event that you cannot accept your order when it arrives we will store the merchandise for a fee of 5% of the purchase price per month. This fee accrues for each item 30 days after its date of receipt in our warehouse.
  11. In no cases are goods to be returned after acceptance of delivery. Any discrepancies should be noted on the delivery receipt.
  12. Any unusual delivery situation (i.e. spiral staircases, etc.) will require advance notice and possibly an additional charge. Please see the “measuring for your delivery” page on our website.
  13. In the unlikely event that our delivery professionals damage your home or property, you must report the damage in writing on the delivery ticket. Esprit D?cor will not be held responsible for any damage not reported in writing at the time of delivery.
  14. For merchandise carried out or picked up by the customer, Esprit Decor, Inc.’s responsibility for damages ceases when the merchandise leaves our premises. Any damage or warranty claims from picked up merchandise must be brought back to our warehouse.
  15. Esprit Decor, Inc. cannot be responsible for any damages or injuries incurred during the loading or unloading of merchandise from any vehicle other than our own.
  16. Binding Effect. The covenants, terms, conditions, provisions, and undertakings in this agreement shall extend to and be binding upon the heirs, executors, administrators, successors, and assigns of the respective parties hereto, as if they were in every case named and expressed.
  17. Entire agreement. This Order contains the Entire Agreement between the parties and cannot be changed or terminated orally.
  18. Esprit Decor, Inc. reserves the right to cancel an order at any time with a refund of the deposit.
